Client Service Agreement

Last updated October 30, 2026

This agreement is between 298Digital, a Thompson Strategic Ventures, LLC offering, 1317 Gibson Dr, Melissa, TX 75454 ("298Digital," "we," "us"), and the business that buys a plan ("you"). Your plan, billing (monthly or annual), price and start date are the ones you chose at checkout; your Stripe receipt is your order form. You accept this agreement by ticking "I agree to the Terms of Service" at checkout. That counts as your signature. Version: 2026-10-30.

1. What you get

PlanPriceIncluded
Website + AI Assistant$199/moA new website built for your business, hosting, a 24/7 website assistant that answers common questions and captures leads/booking requests, and reasonable small edits.
Starter$249/moEverything in Website + AI Assistant, plus 3 social media posts a week on Facebook and Instagram (and Google Business Profile if yours is verified), and a monthly results email.
Growth$399/moEverything in Starter, plus a 4th weekly post, Instagram & Facebook Reels, a seasonal campaign calendar and a quarterly content refresh.
Pro$549/moEverything in Growth, plus a 5th weekly post (including 2 short videos a month) and YouTube Shorts.

Website changes. We make reasonable small updates (hours, staff, services, photos, wording) within 3 business days of your request. A full redesign or new features beyond your plan are quoted separately before any work starts.

Posts. We create posts from photos you send and from our library of evergreen content that fits your business. If you chose "review first" on your onboarding form, we send posts for approval before they go out; otherwise we post them on schedule.

Google Business Profile. We post to Google only if you have a Google Business Profile that you own, that Google has already verified, and that you've added 298Digital to as a Manager. We don't create or verify Google Business Profiles; verification is between you and Google. If your profile isn't verified, we post to Facebook and Instagram, and we can add Google once you've verified it and given us access. Your plan price is the same either way.

2. Fees and payment

  1. Setup fee. $999, charged once with your first payment. It covers building your website and setting up your accounts. It is never waived and is not refundable.
  2. Recurring fee. Your plan fee is charged automatically by card (through Stripe) on the same day each month, or once a year on annual billing.
  3. Annual billing. 12 months of service for the price of 10, paid up front.
  4. Failed payments. If a payment fails, we'll let you know. If it isn't fixed within 7 days, we may pause posting and your website assistant until it is.
  5. Price changes. We'll give you at least 30 days' notice by email before any price change. Annual plans keep their price until renewal.

3. Term, cancellation and refunds

  1. Month to month. There's no long-term contract. Annual plans run for 12 months and renew yearly unless you cancel.
  2. Cancelling. Email support@298digital.com at least 5 days before your next billing date. Service continues until the end of the period you've paid for.
  3. No refunds. Fees already paid (including the setup fee and annual payments) are not refunded or prorated.
  4. Our right to end service. We may end service with 30 days' notice for any reason, or right away if you don't pay, ask us to post content that is unlawful or misleading, or are abusive to our team. If we end service without cause, we'll refund any unused prepaid months.

4. Launch in 5 business days

  1. Your new website goes live within 5 business days of Day 0 (the business day your first payment clears and this agreement is signed).
  2. The clock pauses while we're waiting on you, for example for your onboarding form, kickoff call, account access, or site approval. It restarts when we have what we need.
  3. Weekends and US federal holidays aren't business days.
  4. If we miss the date for reasons on our side, we'll tell you why and give you a new date.
  5. Platform setup and verification (for example Google Business Profile verification, or connecting Facebook or Instagram) isn't part of the 5-day launch. Your website can go live before a platform finishes verifying your account.

5. Our posting promise

If your scheduled social media posts don't go out in a given month, that month's fee is credited to your next bill. The promise applies when:

  • you've sent at least 4 new photos that month, or approved us using library posts;
  • your social accounts are set up, verified and in good standing with each platform, stay connected, and our access stays in place (Google Business Profile posts aren't part of this promise);
  • if you chose "review first," you reply to post approvals within 3 business days; and
  • the missed posts weren't caused by a platform outage or by a platform restricting your account.

The credit is the only remedy for missed posts.

6. What we need from you

  1. Accurate information about your business, hours, services, prices and policies, and a heads-up when anything changes.
  2. Account access through your own logins. You give 298Digital partner, manager or editor access from your own accounts (Meta Business Suite, Google Business Profile, your domain registrar, etc.). We will never ask for, store or email your passwords. If you send one by mistake, we'll delete it and ask you to change it.
  3. Photos. At least 4 new photos a month, with permission from anyone identifiable in them (see section 7).
  4. Timely replies to approval requests (within 1 business day during onboarding, and 3 business days after launch).
  5. Your platform accounts. Your social media and Google accounts are in your name, and you're responsible for completing any verification, identity or security checks the platforms require. We'll guide you through them, but we're not responsible for delays, rejections, suspensions or limits a platform places on your account.
  6. Your industry's rules. You're responsible for making sure content about your products and services follows any advertising, licensing or industry rules that apply to your business. Please review anything that makes a claim about results, safety, pricing or credentials.

7. Photos, content and consent

  1. You confirm you have the right to every photo, logo and piece of content you send us, and written consent from anyone identifiable in a photo (or from a parent or guardian for anyone under 18). Our photo consent form is at 298digital.com/consent/<your link>, which we send you during onboarding.
  2. We won't post a photo of an identifiable person without consent on file, and we never post your customers' last names or private details.
  3. You're responsible for content you provide. You agree to cover our costs if a claim arises from content you supplied without the rights to use it.
  4. We may show your website and posts as examples of our work and list your business as a client. You can opt out at any time by email.

8. Privacy and sensitive information

  1. We only collect basic contact details. Your website assistant and forms collect a name, phone number, email and the visitor's request (for example, a preferred appointment time or a quote request).
  2. Please don't send us customer records or sensitive information, such as health or medical information, payment card or bank details, Social Security numbers, or passwords. 298Digital is not a HIPAA business associate and doesn't sign business associate agreements, so businesses covered by HIPAA must not share protected health information with us.
  3. Your website includes a privacy policy explaining what visitors' information is collected and how it's used.

9. Your website assistant

The assistant answers from the information you give us. It never gives professional advice (for example medical, legal, financial or safety advice) or promises prices or results you haven't approved; it points people to your phone number or booking link instead. Like any automated tool, it can occasionally get something wrong. Tell us and we'll fix it within 3 business days. Please review its answers during onboarding.

10. Who owns what

  1. You own your domain name, your business name and logo, your photos, your content (text you provide), your social media accounts, and the leads and booking requests your website collects.
  2. We own our website templates, design system, code, tools and processes, and we license them to you while you're a client.
  3. When you cancel: your website comes down at the end of your paid period. Within 30 days of cancelling, on request, we'll send you your content (text and images) and point your domain wherever you'd like. Posts already published stay on your accounts; please remove 298Digital's access from your accounts, or we'll remove ourselves.

11. No guarantees of results

We work hard to make your business look great online and stay active, but we don't guarantee specific rankings, traffic, leads, bookings or revenue, or that any platform will verify, approve, or keep your account or posts active. Platforms like Google, Facebook and Instagram control their own algorithms and rules.

12. Limits on liability

Our total liability under this agreement is limited to the fees you paid us in the 3 months before the claim. Neither of us is liable for indirect or lost-profit damages. Nothing here limits liability that can't be limited by law.

13. Confidentiality

We each keep the other's non-public business information confidential and use it only to deliver or receive these services.

14. General

  1. Texas law governs this agreement, and any dispute will be handled in Collin County, Texas.
  2. We're an independent contractor, not your employee.
  3. This agreement (with your checkout receipt) is the whole agreement. Changes must be in writing, and email counts.
  4. Electronic signatures are valid and binding.
  5. If any part of this agreement can't be enforced, the rest still applies.
